US Imposes Record $50M Fine on American Airlines for Disability Rights Violations

On October 23, 2024, the U.S. Department of Transportation (USDOT) announced a landmark penalty against American Airlines, imposing a record-breaking fine of $50 million for what has been described as "numerous serious violations" of laws designed to protect airline passengers with disabilities. This fine, the largest of its kind, marks a significant moment in the enforcement of passenger rights, particularly highlighting the treatment and mishandling of mobility devices, including wheelchairs.

The investigation by the DOT, spanning from 2019 to 2023, uncovered instances where American Airlines failed to provide adequate physical assistance, leading to injuries and what has been described as undignified treatment of wheelchair users. Additionally, there were repeated delays in providing wheelchair assistance, which is crucial for timely boarding and disembarking.

One particularly noted incident involved an American Airlines employee mishandling a wheelchair at Miami International Airport, an event captured on video, which played a role in the DOT's decision to impose this hefty penalty. The fine is structured in a manner intended not only to penalize American Airlines but also to drive systemic change within the airline industry.

Half of the $50 million, $25 million, must be paid directly to the U.S. Treasury as a fine. The remaining $25 million is mandated to be invested in improvements aimed at reducing incidents of wheelchair damage, implementing a systemwide wheelchair tagging system to enhance tracking and reduce delays, and other measures to compensate affected passengers.
